How to Schedule an Eviction in Montgomery County, Maryland

Step 1: File with the Court

  • File for a warrant of restitution (District Court) or a writ of possession (Circuit Court).

  • Obtain the Judge’s signed order. The Sheriff’s Office cannot schedule an eviction until they receive the original order directly from the court.

Step 2: Call the Sheriff’s Office

  • The plaintiff (landlord) or an authorized representative must contact the Sheriff’s Eviction Section to schedule the eviction.

  • Be ready to provide the name listed on the court order.

  • Best times to call: Monday–Friday, 10:00 AM – 2:00 PM.

  • Evictions are scheduled in one-hour time slots: 10:00 AM, 11:30 AM, or 1:00 PM.


What’s Required on the Day of Eviction

The landlord (or authorized representative) must be present at the scheduled time with keys or entry codes. The following must also be provided:

  • Moving crew size (minimum):

    • 8 movers for a 1-bedroom apartment

    • 10 movers for a 2-bedroom apartment

    • 12 movers for a 3-bedroom apartment

    • 15 movers for a townhome

    • 20 movers for a single-family detached home

  • Supplies & Equipment:

    • Heavy-duty trash bags and boxes

    • Tools for disassembling tenant property if needed

    • A box truck, if required, to relocate belongings to the nearest public space

    • A locksmith, if deputies need assistance gaining entry

⚠️ If proper resources (crew, truck, locksmith, supplies) are not available on time, the eviction may be rescheduled by the Sheriff’s Office.

Anne Arundel County Eviction Overview

Validity of Court Order:

  • A Warrant of Restitution or Writ of Possession is valid for 60 days from the date of issue.

  • The eviction may be executed at any time within this window.

  • The Sheriff’s Office typically contacts the landlord or plaintiff within 7 days of receiving the order to schedule a mutually agreeable eviction date and time.

  • Evictions are conducted during court hours so that any legal issues can be immediately addressed.

Requirements on Eviction Day:

  • An eviction is only legal if a Deputy Sheriff is present. The deputy’s role is solely to maintain peace.

  • The landlord is responsible for:

    • Providing an adequate number of movers

    • Exercising reasonable care in handling the tenant’s property

  • If the landlord fails to provide enough movers to complete the eviction within 2 hours, the eviction will be rescheduled.

  • A locksmith may be required if entry is not otherwise possible.

Handling Tenant Property:

  • The tenant may usually remain on-site until all belongings are removed, as long as they are not disruptive.

  • All personal property, except items posing a safety hazard, must be placed on the curb of the nearest public roadway. Once there, safeguarding the property becomes the tenant’s responsibility.

  • After the eviction is complete, any unclaimed or abandoned items become the landlord’s responsibility.

County Code Compliance:

  • Under Article 13, Section 1-106 of the Anne Arundel County Code, landlords must remove a tenant’s property from a County right-of-way within 48 hours.

  • If not removed, the Department of Public Works (DPW) will clear and dispose of the items, billing the property owner for all costs incurred.

Prince George’s County Eviction Requirements

Crew Size (minimum):

  • 1-bedroom apartment/condo: 10–12 movers

  • 2-bedroom apartment/condo: 12–15 movers

  • 3+ bedroom apartment/condo: 15–20 movers

  • Commercial eviction: 25 movers

Additional Requirements:

  • The landlord or an authorized representative must be present during the eviction.

  • Heavy-duty trash bags are required.

  • A locksmith (or someone able to provide access) must be on-site.

According to the “premises described as” section on the Warrant of Restitution and the Office of the Sheriff’s Landlord & Tenant Standard Operating Procedures (SOPs), movers, heavy-duty trash bags, and a locksmith are mandatory for executing an eviction/lockout.

 

⚠️ If these requirements are not met, Prince George’s County deputies will cancel the eviction on site.

On the day of the eviction:

 

The landlord or agent must be present at the time of the eviction.

 

The landlord must provide the following:

1. A moving crew of at least:

        •6 people for a one bedroom apartment

        •8 people for a two bedroom apartment

        •10 people for a three bedroom apartment

        •12 people or more for a townhouse or single family house

        •15 people or more for a business

 

The above numbers may be adjusted by the Sheriff’s Office based on the knowledge of the number of items in the residence or business.

 

2. The landlord is responsible for providing a certified locksmith if a key for entry is not available.

 

3. The landlord is to provide enough trash bags for removal of property and tools to disassemble furniture, if necessary.

 

**If sufficient help or supplies are not on scene at the time of the eviction, it will be rescheduled for a later time and date for the landlord to have the appropriate help. These requirements are in place to ensure that the eviction is completed in a timely manner.

 

If property is removed from the premises, the tenant is given 24 hours to collect their property. After 24 hours it is the responsibility of the landlord to remove any remaining items.
